BAKU INSISTS SAFAROV WAS UNDER STRESS WHEN COMMITTING HOMICIDE
11.05.2005 05:44
/PanARMENIAN.Net/ `The outcomes of the second court medical examination did
not confirm the results of the first one. Since the experts disagreed on the
psychological state of Ramil Safarov when committing the crime, Judge Andras
Vaskuti announced that the two groups of doctors, who carried out the
examination, should be present at the next sitting scheduled for September
27, Echo newspaper reported according to Azeri lawyer Adil Ismaylov. To
remind, the trial of Ramil Safarov started last November. He is accused of
the murder of Armenian officer Gurgen Margarian when doing a training course
in English within Partnership for Peace NATO program in Hungary. The
previous court sitting was held on February 8, 2005. Safarov is charged with
Article 166.2 (murder with aggravations) of the Hungarian Criminal Code
providing for 10-15 years of imprisonment or life imprisonment. `To the
expectations of the defendants the outcomes of the first examination,
according to which Safarov was found sane when committing the homicide, were
not confirmed. The examination carried out on the fourth day after the
murder showed that `it was planned and committed in cool blood'. However the
result of the second examination lifted the veil from the incident', the
newspaper writes. In the words of Adil Ismaylov, Ramil Safarov was under
stress during the incident. As it is known, Safarov underwent the second
examination at request of the Azeri party. By decree of the Hungarian Court
two Azeri experts were allowed to be present at the examination as
observers. When commenting on the experts' conclusions on Safarov's
psychological state the Azeri lawyers characterized it as `more impartial'.
At the same time he conditioned the shortness of yesterday's court sitting
by the lack of disputes between the experts of the two medical examinations.
In this view he noted that two witnesses on the Azeri side are expected to
be present at the next sitting. The prosecution was represented by
Prosecutor Margit Chohayn. Adil Ismaylov had the status of assistant to
lawyers Peter Zalay and George Madiar. To note it was Madiar to initiate the
second examination with the participation of the Azeri experts on February 8
