    "The request-recommendation sent to the Prosecutor of Vayots Dzor by
    the Head of the RoA Special Investigation Service, Andranik Mirzoyan,
    is a rough breach of the RoA Criminal Procedure," said Armenia's
    Human Rights Ombudsman Armen Harutiunian after a thorough study of
    the document.

    "The addressee of a criminal recommendation can be a pre-investigation
    or post-investigation body and not a prosecutor," he said.

    Reminder, Andranik Mirzoyan had assigned the Prosecutor of Vayots
    Dzor to re-examine the heads of pre-election offices for Levon
    Ter-Petrossian, find out their phone numbers, property size,
    interrogate their neighbours, acquaintances and the drivers who had
    transported people to rallies.

    The Ombudsman thinks the relevant bodies should find out whether
    Mirzoyan had filed similar request-recommendations to other prosecutors
    as well.

    "The request is illegal and Mirzoyan cannot "be engaged" in the
    case on the grounds of the criminal recommendation. It is beyond
    his competence. Moreover, relevancy of the investigative actions and
    admissibility of evidence is put under question as a result of the
    request," says the Ombudsman.

    "Andranik Mirzopyan forced the prosecutor to violate the RoA Criminal
    Code."

    Reminder, the recommendation was publicized by Levon Ter-Petrossian
    who said the document was authored by Robert Kocharian.
