Will Karabakh Constitution Change?

On December 10, Karabakh celebrated the day of referendum on
independence and Constitution.
Twenty years past the day when people voted for independence from
Azerbaijan, the country is in a post-conflict depression. The cause of
the depression is the complex of inferiority. The people of Karabakh
are always looking for someone to guide it.
The people of Karabakh gained the right of master during the war the
results of which have never been questioned by anyone except
Azerbaijan. Perhaps also Armenia, which has just started refusing
different principles of resolution which question the territorial
integrity of Karabakh.
Unlike the people of Karabakh, the government of Karabakh also has
doubts. Adopting the Constitution 5 years ago, the government
introduced a provision according to which the NKR sovereignty extends
over the territories under its jurisdiction until the problem of
Karabakh is resolved.
This impotent phrase caused the dissatisfaction of the Armenian
society. At that time, the press reported that the Constitution of an
independent country cannot contain such a provision. The government
explained that Azerbaijan still controls some territories of Karabakh
but it was a weak excuse. This provision could be laid down only upon
the recommendation of Armenia which took part in the negotiations and
did not want to talk to the mediators about the territorial integrity
of NKR. It was noted that it would mean predetermination of the
outcome of the negotiations and loss of the possibility to maneuver.
But five years have passed, the negotiations are getting closer to the
legitimization of the status quo, which is the present border, and it
is clear that the past five years were wasted. They were wasted by the
government of Karabakh due to their lack of diplomatic courage.
Interestingly, on the fifth anniversary of the Constitution, the head
of the NKR National Assembly Standing Committee of Foreign Affairs
Vahram Atanesyan proposed amendments to this provision.
`If you ask my opinion, Article 142, the last article of the NKR
Constitution, which defines the border of the state, must be changed,'
Atanesyan said, noting that the factual borders of NKR must be laid
down in the Constitution. According to Atanesyan, I must be laid down
in the 3rd or 4th rather than the last article. It must have an immune
status.
