Individual complaint against Azerbaijan and Hungary in ECHR (added)

Hayk Mukuchyan, the soldier of RA Armed Forces, the successor and
miraculously survivor of Gurgen Margaryan, the soldier of RA Armed
Forces brutally killed in Hungary by the Azerbaijani officer Ramil
Safarov, filed individual complaints to the European Court of Human
Rights against Azerbaijan and Hungary.
Today RA Deputy Ministers of Justice Yeghishe Kirakosyan and Ruben
Melikyan told the journalists that according to their information the
applicants require to identify the right to life and prohibition of
discrimination, prescribed in 2nd and 14th Article of the European
Convention on Human Rights. According to the Armenian side, those
rights were violated in transfer of the murderer by the Hungarian side
to Azerbaijan, and for the former by granting him a pardon, even
justifying and making a hero. The group of attorneys is comprised of:
Siranush Sahakyan, Narine Gasparyan, Nazeli Vardanyan, the
representative of G.Margaryan and H.Mukuchyan in the Hungarian court
and foreign lawyers.
It should be noted that in accordance with European Convention for the
Protection of Human Rights and Fundamental Freedoms, Armenian side
will be involved in the processes as a third party.
Armenia's Ministry of Justice is convinced that the transfer of the
murderer by Hungary, and the granting of forgiveness by the President
of Azerbaijan, his actual justification and making a hero, are gross
violations of International Law, so the Armenian side have taken and
will continue to take all the steps to fix the fact of the violation
by authoritative international bodies and in the capacities of
international law for the recovery of the violation of law.
The deputy ministers informed that on October 9, 2012, the RA Ministry
of Justice submitted an application to the expert group of Council of
Europe on criminal cases demanding to discuss the proportionality of
the Article 12 of Strasbourg Convention on the Transfer of Prisoners
(which reserves the right to grant pardon and amnesty) to Azerbaijan,
>From the perspective of international law.
RA Ministry of Justice is preparing an application to be submitted to
the UN Committee on the Elimination of Racial Discrimination based on
Article 11 of the UN Convention. In the application the Armenian side
will draw the attention of the international structure of the
anti-discrimination policy and the campaign of hatred against
Armenians in Azerbaijan.
