    On December 10, 2006, the citizens of the NKR adopted the Constitution
    of the Nagorno Karabakh Republic by a referendum. It will be no
    exaggeration to note that this event became the most important in the
    public-political life of the Republic and marked a new stage in the
    process of building the independent statehood of Nagorno Karabakh. It
    is noteworthy that December 10 is doubly significant for the people
    of Artsakh, as it entered the modern history of Artsakh even earlier,

    15 years before the constitutional referendum. On the same day in
    1991, and again at a national referendum, the people of our Republic
    definitely declared for the national independence of the NKR.

    Surely, such a coincidence of both historical dates can be regarded
    as an accident and a happy coincidence, but these two important
    political acts are in a close and natural connection with each
    other. The fact is that even though the two events are separated from
    each other by 15 years, however, they are links of the same chain -
    the state-building process.

    It is important to note that the fifteen years separating the
    two truly crucial referendums, which predetermined the further
    development of Nagorno Karabakh as an independent state, included
    the most important steps towards the creation of the institutional
    foundations of the young Republic. They included, first of all,
    the adoption of the Declaration on the State Independence of the
    Republic on January 6, 1992 by the NKR Supreme Council, as well as
    of a block of constitutional laws on the President, Parliament and
    Government and other legal acts defining the basic principles of the
    state institutions' operation. Or, the necessary legislative basis
    was created to regulate the relations, actually, in all the spheres
    of the public-political life of the Republic, which proclaimed the
    rule of law one of its main principles.

    However, the progressive development of the state-building process
    and the public relations imperatively put forward as a natural step
    the task to elaborate a Constitution. The adoption of the NKR Basic
    Law was the logical continuation and a peculiar apotheosis of the
    legislative process, since it serves as the foundation of a legal
    state's legislation, ensuring the constitutionality of all the laws
    and regulating the relationship of the citizens between the state
    andamong themselves, regulating the activities of various spheres
    of the public-political life. The Constitution legally endorsed the
    achievements of the Republic in the creation and strengthening of the
    sovereign state and the imperatives that determine the development
    of the society and the state. It is rightfully considered the major
    and the basic law, because it is an important factor in ensuring the
    domestic stability in the state.

    It should be noted that the NKR people, from the first day of its
    independence, proclaimed the commitment to the law and democratic
    values. That is why the adoption of the Constitution was also due
    to the desire of the citizens of the Republic to build their lives
    based on the universally recognized human rights and freedoms as the
    inalienable and supreme values of a civilized community. This national
    expression of will found its visible reflection in the Constitution,
    the first article of which reads as follows: "The Nagorno Karabakh
    Republic is a sovereign, democratic, legal, and social state". It
    should be stressed that the rights and freedoms of citizens and the
    guarantees of real democracy were not merely declared and endorsed by
    the Constitution as the necessary standards, but they were claimed
    and found their practical implementation in the real life. This
    is confirmed, in particular, by the nationwide presidential,
    parliamentary, and municipal elections held during the years of
    independence, thanks to which one of the most important provisions
    of the Constitution - the direct participation of the people in the
    state governance - was observed.

    The fact that the process of state-building took place in the hard
    conditions of the armed aggression of Azerbaijan and then - the
    post-war rehabilitation of the Republic, with the constant threat
    by official Baku to unleash a new war against the NKR, makes even
    more significant the achievements of the people of Artsakh on the way
    to building a sovereign and democratic state. It also gives a strong
    ground to the international community to appreciate our desire to build
    a truly democratic state, our will and ability to live according to the
    laws of the civilized world. In this context, also of a foreign policy
    significance is the adoption of the NKR Constitution as an attribute
    of an established state possessing the necessary and viable state-
    and public institutions. And first of all, from the point of view of
    the prospects of international recognition of the NKR statehood.

    But, in any case, we have chosen the democratic path of development and
    are creating the constitutional foundations of our statehood, surely,
    not for the international community, but, first of all, for ourselves
    and for a guaranteed future of our children. It is a conscious and
    a hard-won choice of the people of Artsakh. It is a crucial choice,
    the correctness of which has been confirmed by the life itself.
