The government decree on building and distributing apartments
to the families left homeless due to the 1988 earthquake and its
further amendments have a lot of drawbacks and does not withstand
the examination during enforcement. It is clear that there is not a
perfect law, however, it should be improved and refined during its
enforcement. The RA Ministry of Urban Development taking the chance
of imperfectness of the law has a developed script, which is to delay
apartment privatization process until the owner 's death, then to take
it back by the court and give it to someone else, and thus to solve the
housing problem of two families with one apartment. As you can see, not
a bad idea. During the earthquake, our family: my father, my mother,
and my 3 sisters lost 3-room apartment. The disaster was all over the
country, we had to endure. Like many, we also took shelter, and lived
for 20 years. My sisters got married. Two sisters were lucky. The
husbands had apartments, whereas I was not lucky. On January 2008,
my father, participant in elimination of the Chernobyl disaster,
Harpik Baghdasaryan, died suddenly. My mother, Stelina Baghdasaryan,
was left in the list of recipients of 1-room apartments.
On June 14, 2010 the RA Government certificate dated March 11, 2010,
and the the keys to the apartment No 17, building 6, Mush-2 District,
in the presence of the President of Armenia, were delivered to my
mother, as well as to other inhabitants of the district. The next
day we started the housewarming party and furnishing the apartment,
on the one hand, mourning my father's death, on the other hand,
being comforted that 22 years later we could get at least one-room
apartment. Neither of us had ever believed that it was still not our
house. A month later, people from an agency are visiting our apartment
to take the dimensions; they did their job, and on leaving they said
that soon we will be given the certificate of ownership. 2 months
later, on August 2010, my mother is going to the Real Estate Cadastre
department, is asking for the certificate of ownership, and receiving
the following answer, "Why do you need that piece of paper? Go and
live. Will the certificate heat you? Are we going to die and leave
you without the certificate?" I do not know, I do not wish any person
from the RA Ministry of Urban Development or Cadastre department to
die, but on September 17, 2010, a tragedy happened and my mother died
from stroke all of a sudden. Still 15 days before my mother's death,
all the apartments of the district, including our turned out to be
the property of the Republic of Armenia, from whom we already had
the certificate and where we were living for 3 months. On November
2, 2011, a group of 12 high-ranking officials from the police, the
Ministry of Urban Development, Shirak regional administration, and
Gyumri municipality entered our apartment and demanded the keys to
the apartment, took it, and leaving us in the cold winter outdoors,
went away. Later, I learned about a protocol on the search where it
was stated that the bathroom shower was missing. Of course, the shower
was under the bathtub, should I knew, I would have given it to them,
they were men, perhaps, they could fix it. The Committee, of course,
had not mentioned the furnishings in the protocol: the furniture,
carpets, and curtains. To justify their actions, they invented that
an Interpol investigation is announced against me. Over the 20 years,
I was not absent from the city, moreover, I was not absent from my
mother's apartment a single day. Where should I go? Whom to escape
from? What should I fear from? On July 13, 2013, the RA Ministry
of Urban Development sued to the court of general jurisdiction of
Shirak marz and asked "to evict Hasmik Baghdasaryan from one-room
apartment." When I ask what is the fault of our parents or my sisters,
they responded that first my parents had no right to leave this world
early before receiving the certificate of ownership, if they wanted
to own something, you were to live longer, 22 years was few. As for
the fault of your sisters, in the past 20 years they should not marry
a person with no apartment. It appears that marriage is early death
is a sin.
Dear Prime Minister T. Sargsyan, dear Minister of Justice H.
Tovmasyan, I know, you are not even trying to look for legislative
and separate individuals culpability in all of these. I allow myself
to offer introducing one of the following options in the regulation on
delivering apartments. While delivering the RA Government certificate
and the keys to the apartment, warn the inhabitant in written not to
die suddenly or to marry, and that after demolishing the temporary
shelter and handing over the keys and the certificate, in case of the
death of the inhabitant or a family member, the apartment is passed
to the heir or other family members. Thus, the official document
with coat of arms of Armenia becomes useless and worthless, purely
symbolic ostentation. President of Armenia Serzh Sargsyan, I ask for
your petition to the Government of Armenia to take me the application
of eviction back and resolve the issue after bringing the guilty
parties to responsibility for delaying the privatization process.
