THE FIRST TRIAL AT THE NKR COURT OF APPEALS

On February 26, the Court of Appeal of the Nagorno Karabakh Republic
held a sitting in the framework of the criminal case against the
members of the Azerbaijani sabotage and reconnaissance group, which
had illegally crossed the state border of the NKR, Dilham Askerov
and Shahbaz Guliyev. The trial was held by judges Hrayr Abrahamyan
and Karen Safaryan and chaired by Norayr Grigoryan.
Judge G. Abrahamyan read out those articles, under which D. Askerov
and Sh. Guliyev were accused, and then the defendants' lawyers,
Eric Beglaryan and Arkady Israelian, presented the justification
related to the appeal, according to which the decision taken by the
court of the first instance of general jurisdiction does not satisfy
their defendants.
Eric Beglaryan noted that the first-instance court's decision regarding
his client Askerov is partially to be appealed, and Arkady Israelyan
assured that the decision regarding his client would be appealed
completely.
In turn, the public prosecutor, Karen Gabrielyan, presented the
arguments regarding the trial and the expertise results, including on
the part of espionage, murder, filming, kidnapping, and weapons. The
assignee of killed Smbat Tsakanyan - Mekhak Tsakanyan - noted in his
speech that he disagreed with the appeal against the sentence of the
defendans, since, in his view, the court had taken a fair decision.
During the sitting, defendants Dilham Asgaov and Shahbaz Guliyev,
presenting their complaints, in particular, noted that they disagreed
with the decision of the first-instance court of general jurisdiction
of the NKR, as crossing the border between the NKR and Azerbaijan,
they did not realize that it was illegal. The defendants assured that
they had not committed espionage and pleaded not guilty to murder.
"I was not involved with the special services of Azerbaijan and do not
know whether Hasan Hasanov (the other, killed member of the criminal
group) was an employee of the special services of Azerbaijan", said
Dilham Askerov, adding that he hadn't killed Smbat Tsakanyan, it had
been done by Hasan Hasanov. As for his videos placed at the Internet,
Askerov could not answer who could do it.
In turn, defendant Guliyev continued pleading not guilty on any of
the articles of accusation.
After hearing the sides, the court scheduled the next hearing for
March 10.
Let's remind that Dilham Askerov was charged for crimes under seven
articles of the NKR Criminal Code and Shahbaz Guliyev - under five
articles.
The defendants were charged with espionage, crossing the protected
state border of the NKR without corresponding documents or
authorization, illegal possession of firearms and weapons, kidnapping
with the use of force dangerous to life or health, with the use of
weapons against a teenager, murder motivated by ethnic hatred. Dilham
Askerov was also charged for the attempted murder of two individuals
motivated by ethnic hatred.
On December 29, 2014, Dilham Askerov was sentenced to life
imprisonment, Shahbaz Guliyev - to 22 years in prison.
