Organized Crime Department author of anti-piracy bill

The Legal and Organized Crime Departments of the Armenian Police have
proposed amendments to the Criminal and Administrative Codes to
strengthen the protection of copyright and adjacent rights, and reduce
piracy.
The initiative is expected to enhance the effectiveness of the
Armenia-EU negotiations over the Deep and Comprehensive Free Trade
Area Agreement.
Both bills, available on the official website of the Police, were
elaborated under a May 2009 presidential decree in an attempt to
ensure the implementation of the measures under the European
Neighborhood Policy.
The Police calls for reviewing Articles 158 (Breach of copyright and
adjacent rights) and 197 ( Illegal use of trade mar) of the Criminal
Code to impose a fine in the amount of 200 and 400 of the minimal
salary or imprisonment for up to one month, for the appropriation of
authorship.
A stricter punishment is proposed in case there is documented evidence
that such appropriation assumed larger scales (fine in the amount of
500-1000 minimal salary and imprisonment for up to two months).
In case the violations were committed in circumvention of technical
protection means and based on a prior agreement by a group of
individuals, the perpatrators will face up to two years in prison.
Under the proposed amendments, fictitious advertising (Article 197)
will be punished for up to one year in prison. Agravating
circumstances will extend that term to maximum two years.
